These Terms of Service ("Terms") govern your access to and use of Earnest ("the Service"), operated by Earnest ("we," "our," or "us"). By accessing or using Earnest, you agree to be bound by these Terms.
Earnest is an AI-powered platform that helps UGC creators discover brands, generate personalized outreach emails, and manage their brand deal pipeline. The Service uses artificial intelligence to draft outreach emails based on your creator profile. All AI-generated content is a draft — you are responsible for reviewing and approving any communications sent on your behalf.
You must be at least 18 years old and capable of forming a legally binding contract to use Earnest. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the accuracy of your creator profile, including your social media handles, follower counts, niche, and rate information. You agree not to provide false or misleading information. You are responsible for all activity that occurs under your account.
You agree to use Earnest only for lawful purposes. You may not:

Earnest offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at checkout. Founding member pricing is locked for the duration of your active subscription. If you cancel and resubscribe, standard pricing applies.
All payments are processed securely. We do not store your payment card information on our servers.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days at earnestmanagement4@gmail.com.
If you complete your creator profile in full, send outreach to at least 50 brands in your first 30 days using Earnest Pro, and receive zero brand replies, contact us and we will issue a full refund for your first month. This guarantee applies to new Pro subscribers only and requires proof of outreach activity within the platform.
The Earnest platform, including its design, code, and branding, is owned by Earnest and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
Earnest is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved. Income projections shown on the platform are illustrative estimates based on industry averages and are not guarantees.
To the fullest extent permitted by law, Earnest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of income, lost brand deals, or reputational harm. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
